INFORMATION WE COLLECT FROM YOU

• Information you give us (Submitted information): This is information you give us about you by filling in forms on the App Site and the Services Sites (together Our Sites), or by corresponding with us (for example, by e-mail or chat). It includes information you provide when you register to use the App Site, download or register an App, subscribe to any of our Services, search for an App or Service, make an in-App purchase, share data via an App’s social media functions, enter a competition, promotion or survey, and when you report a problem with an App, our Services, or any of our Sites. If you contact us, We will keep a record of that correspondence. The information you give us may include your name, address, e-mail address and phone number, the Device’s phone number, age, username, password and other registration information, financial and credit card information, personal description and photograph. 
• Information we collect about you and your device. Each time you visit one of our Sites or use one of out Apps we will automatically collect the following information:
• technical information, including the type of mobile device you use, a unique device identifier (for example, your Device’s IMEI number, the MAC address of the Device’s wireless network interface, or the mobile phone number used by the Device),mobile network information, your mobile operating system, the type of mobile browser you use, time zone setting, (Device Information); 
• information stored on your Device, including contact information, friends lists, login information, photos, videos or other digital content, check ins,  (Content Information);
• details of your use of our App or your visits to any of Our Site including, but not limited to traffic data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access (Log Information). 
• Location information. We also use GPS technology to determine your current location. Some of our location-enabled Services require your personal data for the feature to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose. You can withdraw your consent at any time by following the instruction listed in our website.
• Information we receive from other sources (Third Party Information). We are working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies). We will notify you when we receive information about you from them and the purposes for which we intend to use that information.
• Unique application numbers: when you install or uninstall a Service containing a unique application number or when such a Service searches for automatic updates, that number and information about your installation, for example, the type of operating system, may be sent to us.

We use cookies to distinguish you from other users of the App, App Site, Appstore or Service Site. This helps us to provide you with a good experience when you use the App or browse any of the sites and also allows us to improve the App and Our site. We may associate any category of information with any other category of information and will treat the combined information as personal data in accordance with this policy for as long as it is combined.

We do not disclose information about identifiable individuals to our advertisers, but we may provide them with anonymous aggregate information about our users (for example, we may inform them that 500 men aged under 30 have clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target (for example, women in SW1). We will make use of the personal data we have collected from you to enable us to comply with our advertisers’ wishes by displaying their advertisement to that target audience.

You agree that we have the right to disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries.

We will disclose your personal information to third parties:

• In the event that We sell or buy any business or assets, in which case We will disclose your personal data to the prospective seller or buyer of such business or assets.
• If We are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation or request. 
• In order to:
• enforce or apply the EULA, Our Terms of Use  and other agreements or to investigate potential breaches; or 
• protect the rights, property or safety of our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

PAYMENT

You understand that after you have received services or goods obtained through your use of the Service, SOA( YEMI SHOYEMI) will facilitate your payment of the applicable Charges on behalf of the Third Party Provider as such Third Party Provider’s limited payment collection agent. Payment of the Charges in such manner shall be considered the same as payment made directly by you to the Third Party Provider. 

Charges will be inclusive of applicable taxes where required by law. Charges paid by you are final and non-refundable, unless otherwise determined by SOA( YEMI SHOYEMI) . SOA( YEMI SHOYEMI ) will respond accordingly to any request from a Third Party Provider to modify the Charges for a particular service or good.

All Charges are due immediately and payment will be facilitated by SOA( YEMI SHOYEMI)  using the preferred payment method designated in your Account, after which SOA ( YEMI SHOYEMI) will send you a receipt by email. If your primary Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that SOA( YEMI SHOYEMI ) may, as the Third Party Provider’s limited payment collection agent, use a secondary payment method in your Account, if available.

As between you and SOA( YEMI SHOYEMI) , SOA(YEMI SHOYEMI)  reserves the right to establish, remove and/or revise Charges for any or all services or goods obtained through the use of the Services at any time in SOA’s sole discretion. Further, you acknowledge and agree that Charges applicable in certain geographical areas may increase substantially during times of high demand. SOA( YEMI SHOYEMI)  will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof.

SOA( YEMI SHOWYEMI) may from time to time provide certain users with promotional offers and discounts that may result in different amounts charged for the same or similar services or goods obtained through the use of the Services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the Services or the Charges applied to you. You may elect to cancel your request for services or goods from a Third Party Provider at any time prior to such Third Party Provider’s arrival, in which case you may be charged a cancellation fee.

SOA(YEMI SHOYEMI) does not designate any portion of your payment as a tip or gratuity to the Third Party Provider. Any representation by SOA(YEMI SHOYEMI) (on SOA ( YEMI SHOYEMI) website, in the Application, or in SOA’s marketing materials) to the effect that tipping is “voluntary,” “not required,” and/or “included” in the payments you make for services or goods provided is not intended to suggest that SOA( YEMI SHOYEMI ) provides any additional amounts, beyond those described above, to the Third Party Provider. You understand and agree that, while you are free to provide additional payment as a gratuity to any Third Party Provider who provides you with services or goods obtained through the Service, you are under no obligation to do so. Gratuities are voluntary. After you have received services or goods obtained through the Service, you will have the opportunity to rate your experience and leave additional feedback about your Third Party Provider.

LIMITATION OF LIABILITY

SOA (YEMI SHOYEMI) shall not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost data, personal injury or property damage related to, in connection with, or otherwise resulting from any use of the services, even if SOA (YEMI SHOYEMI) has been advised of the possibility of such damages. SOA(YEMI SHOYEMI) shall not be liable for any damages, liability or losses arising out of:

1. Your use of or reliance on the services or your inability to access or use the services; or 
2.  Any transaction or relationship between you and any third party provider, even if SOA(YEMI SHOYEMI) has been advised of the possibility of such damages.
   
   SOA(YEMI SHOYEMI) shall not be liable for delay or failure in performance resulting from causes beyond SOA’s reasonable control. SOA’s services may be used by you to request and schedule transportation, goods or logistics services with third party providers, but you agree that SOA(YEMI SHOYEMI) has no responsibility or liability to you related to any transportation, goods or logistics services provided to you by third party providers other than as expressly set forth in these terms.
   
   The limitations and disclaimer in this section do not purport to limit liability or alter your rights as a consumer that cannot be excluded under applicable law.

REPAIR OR CLEANING FEES

You shall be responsible for the cost of repair for any damage to or necessary cleaning of the third party service provider’s ride as a result of your misuse of the Service or in breach of the Terms of Use herein. The Company reserves the right to facilitate payment for reasonable cost of such repair or cleaning on behalf of the third party service provider via your designated payment method or demand from you in cash, in the event a request for repair or cleaning request by the third party service provider has been verified by the Company.

Where We store your personal data

All information you provide to us is stored on our secure servers. Any payment transactions carried out by us or our chosen third-party provider of payment processing services will be encrypted. Where We have given you (or where you have chosen) a password that enables you to access certain parts of Our Site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although We will do our best to protect your personal data, We cannot guarantee the security of your data transmitted to Our Site; any transmission is at your own risk. Once We have received your information, We will use strict procedures and security features to try to prevent unauthorised access. 
We will collect and store personal data on your Device using application data caches and browser web storage (including HTML 5) and other technology.
Certain Services include social networking, chat room or forum features. Ensure when using these features that you do not submit any personal data that you do not want to be seen, collected or used by other users.

The new terms may be displayed on-screen and you may be required to read and accept them to continue your use of the App or the Services.
